I. General Terms
The client is required to provide references for the character they want the commissioned artist to draw/paint. Clear images or a clear written description of the character is both ideal.
While conversing or discussing, casual yet proper speech is preferred. Any ill behavior, discriminative and disrespectful language or profanities, or any behavior that makes the commissioned artist uncomfortable, will not be tolerated and may result in the commissioned artist dropping the commission if there be any progress made and a refund of only 50% of the price paid.The client is required to agree to these terms and conditions before they begin to discuss anything about the commission with the artist. Failure to follow the procedures/rules gives the commissioned artist the right to cease the commission.II. Payment
The client is required to pay the agreed amount of payment in full upfront unless the artist stated otherwise.
The commissioned artist only accepts payment through PayPal and Gcash. Accepted currencies are USD and PHP.The artist will not begin making the artwork until the payment has been made/received successfully unless the artist stated otherwise.III. Progress
The commissioned artist is obligated to send the client WIPs(images of the artwork in progress) and updates of the commissioned artwork regularly.
WIPs will only be sent in low resolution. The client is not permitted to ask for the WIPs in the original resolution.The client must understand the commissioned artist may take longer than their advertised turnaround time(1-2 weeks) provided that the commissioned artist has a valid reason. The client is free to ask the commissioned artist for any updates regardless and the commissioned artist is obligated to answer the client.Small and minor revisions are indefinite unless the commissioned artist has stated otherwise. The client is permitted to ask for only 1 major revision of the commissioned artwork, any more major revisions will require a revisions fee of 5-10 USD.Once the commissioned work has finished, the client may ask the commissioned artist to edit or enhance the artwork.The finished product will be sent by the commissioned artist as both a jpeg version and a png version in high quality through email, Discord direct messages, or any other way the client prefers.IV. Copyright and Usage Policy
The commissioned artwork is for personal use only. The client is not permitted to sell or reproduce to profit the commissioned artwork in any possible way. If the commissioned artwork is sold as an artwork of an adopt to be sold, fees must be applied and should be negotiated with the commissioned artist.
The client is authorized to print the artwork for any usage other than for commercial purposes. The client is also allowed to use the commissioned artwork to promote the client provided the client has given full credit of the commissioned artwork to the commissioned artist openly. The client must claim ownership of the character being illustrated on the commissioned artwork unless it is fan art or OC x canon.The client is NOT permitted to erase the watermark or signatures of the commissioned artist on the commissioned artwork, replace the watermarks or signatures with theirs, claim ownership of the commissioned artwork, trace the commissioned artwork, or copy the commissioned artwork, OR have another artist do the above actions.Failure to comply with these policies will give the commissioned artist the right to report or create a beware post of the client in question.V. Canceling/Refund Policy
The client has no right to cancel or refund the commissioned artist under any circumstances after the payment has been received, therefore the client is expected to be confident in the commission as soon as they have made their payment. However, if payment has not been made, the client has the right to cancel the commission.
If the client files a chargeback against the commissioned artist, the commissioned artist has the right to cut off ties with the client, file a complaint, and/or upload a beware post of the client in question. The commissioned artist also has the right to the commissioned artwork and may use it in any way they wish.The commissioned artist is also not permitted to cancel or refund the commission unless the artist and the client have come to an agreementBy proceeding to commission the artist, the client has agreed [and agreed to adhere] to all of the terms and conditions above.Sincerely,
